Aylesbury Waterside Theatre’s The Year That’s BEAN Campaign
Terms and Conditions
1. Operator: The operator of this campaign (“Campaign”) is ATG Entertainment Limited, 2nd Floor, Alexander House, Church Path, Woking, GU21 6EJ ("ATG Entertainment").
2. Eligibility: This Campaign is open to all UK residents (excluding Northern Ireland) aged 18 years or over. The Campaign is subject to all applicable laws and regulations. If you are under the age of 18 you must have permission to enter from your parent or guardian. By submitting an entry for the Campaign, your parent/carer/guardian is deemed to have given such consent and to agree to the use of the entry as described in these terms and conditions.
3. Agreement to Terms: By participating, the entrant (the "Entrant", "You") agrees to be fully and unconditionally bound by these terms and conditions, and You represent and warrant that You meet the eligibility requirements set out in paragraph 2 above. In addition, You agree to accept the decisions of ATG Entertainment as final and binding in relation to this Campaign.
4. Campaign Period: All entries must be submitted between 00:01 on 30/07/2025 and 00:59 on 09/11/2025. Entries received after this time will not be considered.
5. How to Enter: Your photo entry must be submitted digitally via the process outlined on the official Campaign webpage. No other forms of entry will be accepted. ATG Entertainment cannot be held responsible for entries that do not arrive due to the Entrant’s internet security settings or restrictions placed by Your Internet service provider.
The Campaign is free to enter, and no purchase is necessary.
Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of ATG Entertainment. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be disqualified at the sole discretion of ATG Entertainment.
By submitting a photo to the Campaign, You confirm and warrant that:
• You own the copyright and any other intellectual property rights of each photo;
• You have the permission of anyone pictured in the photo (or, where the photo shows any persons under 18, the consent of their parent/guardian) for the usage rights required by Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury and will indemnify Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury against any claims made by any third parties in respect of such infringement;
• You have not licensed or disposed of any rights in the photo that would conflict with uses to be made by Aylesbury Waterside Theatre, ATG Entertainment or Snappy Snaps Aylesbury;
• You have received any necessary permissions from the owner(s) of objects including buildings included in the submitted photo for the usage rights required by Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury and will indemnify Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury against any claims made by any third parties in respect of such infringement; and
• Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury have permission to use the photos provided in accordance with paragraph 7 and across their marketing channels.
6. Photo Specification
• Photos must be a minimum 1MB – maximum 5MB file.
• A maximum of 10 photos may be entered per person.
• A photo will be rejected if it appears to have been taken in such a way any laws may have been breached or the content is inappropriate or unclear.
• Only photos taken in 2025 will be considered for selection by ATG Entertainment.
• Aylesbury Waterside Theatre and ATG Entertainment reserve the right to remove or refuse any entries from the Campaign for any reason.
7. Selection: ATG Entertainment will select, in its sole discretion, the entries to be included into a mosaic photo, printed on canvas and exhibited in Aylesbury Waterside Theatre, and featured online.
8. Usage Rights: By entering the Campaign, you grant Aylesbury Waterside Theatre, ATG Entertainment and Snappy Snaps Aylesbury a non-exclusive, irrevocable licence to reproduce, enlarge, publish or exhibit, on any media, the photos for the purpose as outlined in paragraph 7.
9. Cancellation: ATG Entertainment reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorised human intervention, fraud, or other cause beyond ATG Entertainment’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. ATG Entertainment has the right, in its sole discretion, to maintain the integrity of the Campaign, to void any entry where it has reason to believe the Entrant has violated the rules. Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a breach of applicable law. Should such attempt be made, ATG reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering, You agree to release and hold harmless ATG Entertainment and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from Your participation in the Campaign. ATG Entertainment, its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors shall not be liable for (i) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (ii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Campaign; or (iv) electronic or human error in the administration of the Campaign or the processing of entries, save to the extent that such exclusion is not permitted by law.
11. Disputes: This Campaign is governed by the laws of England & Wales. As a condition to participating in this Campaign, You agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court in England. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable legal costs, other than Your actual out-of-pocket expenses (i.e. costs associated with entering this Campaign).
