Website Terms of Use
These are the ATG Tickets(‘Our’, ‘Ours’ ‘We’) terms and conditions (the ‘Conditions’), which apply to the use of the ATG Tickets website by end users. By accessing www.atgtickets.com, you agree to be bound by the Conditions. ATG Tickets is provided for the benefit of residents of the United Kingdom / European Union over the age of 18. If you are not a United Kingdom / European Union resident, over the age of 18 or do not agree to be bound by the Conditions, you may not use or access ATG Tickets and we will have the right to restrict or prevent your access to ATG Tickets.
1 YOUR OBLIGATIONS
1.1 You will not:
(a) use ATG Tickets (or any part of it) for any illegal purpose and agree to use it in accordance with all relevant laws;
(b) upload or transmit through ATG Tickets (i) any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or (ii) any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety;
(c) use ATG Tickets in a manner which (i) may cause ATG Tickets to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of ATG Tickets is in any way impaired or (ii) violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy); and
(d) create or publish a hypertext link to any part of ATG Tickets or attempt any unauthorised access to any part or component of ATG Tickets.
1.2 You agree that in the event that you have any right, claim or action against any end user of ATG Tickets arising out of that end user's use of ATG Tickets, then you will pursue such right, claim or action independently of and without recourse to us.
2 ATG TICKETS RIGHTS
2.1 We reserve the right to:
(a) modify or withdraw, temporarily or permanently, ATG Tickets (or any part of it) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of ATG Tickets ; and/or
(b) change these Conditions from time to time. Your continued use of ATG Tickets (or any part of it) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using ATG Tickets ; and/or
(c) monitor any activity and content associated with ATG Tickets. We may investigate any reported violation of these Conditions or complaints relating to ATG Tickets and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from ATG Tickets).
2.2 We will use our reasonable endeavours to maintain ATG Tickets. ATG Tickets is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of ATG Tickets because of a failure, suspension or withdrawal of all or part of ATG Tickets for any reason.

You acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misrepresentative or defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.
5 ACCESSIBILITY
We take our responsibility for making accessible web content and software seriously. ATG Tickets is committed to ensuring accessibility for people with disabilities and to meeting current accessibility standards, including those defined by the W3C's Web Content Accessibility Guidelines. We are actively engaged in the ongoing process of testing ATG Tickets and currently comply with accessibility standards Level 1. Many Internet users with disabilities find websites difficult to use simply because of the way they are designed. ATG Tickets has been designed to be as accessible as possible and to be compatible with the types of adaptive technology used by people with disabilities, including screen readers.
6 LIMITATION OF LIABILITY
6.1 Whilst we will use reasonable endeavours to verify the accuracy of any information we place on ATG Tickets , we make no warranties, whether express or implied in relation to its accuracy.
6.2 ATG Tickets is provided on an ‘as is’ and ‘as available’ basis without any representation or endorsement. Unless specified in separate terms and conditions relating to a particular product or service, we make no warranties of any kind, whether express or implied, in relation to ATG Tickets , or products or services offered on ATG Tickets whether by us or on our behalf (including free software downloads) including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, condition or completeness, or any implied warranty arising from course of dealing or usage or trade.
6.3 Unless specified in separate terms and conditions related to a particular product or service, we make no warranty that ATG Tickets or products or services offered on ATG Tickets whether by us or on our behalf (including free software downloads) will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that ATG Tickets or the server which makes it available or products or services offered on ATG Tickets whether by us or on our behalf (including free software downloads) are free of viruses or bugs or are fully functional, accurate, or reliable. We will not be responsible or liable to you for any loss of content or material as a result of uploading to or downloading from ATG Tickets.
6.4 Notwithstanding any other provision in the Conditions, nothing shall limit your rights as a consumer under English law.
6.5 You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of ATG Tickets and any information provided to or taken from ATG Tickets by you.
6.6 We will not be liable (i) in contract, tort (including, without limitation, negligence) or otherwise for:
(a) any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
(b) any loss of goodwill or reputation; or
(c) any special or indirect or consequential losses, howsoever arising and;
in any case whether or not such losses were within the contemplation of either of us at the date on which the event giving rise to the loss occurred.
6.7 Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees, or any liability in the tort of deceit.
7 INTELLECTUAL PROPERTY AND RIGHT TO USE
7.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within ATG Tickets shall remain at all times owned by us or our licensors. You are permitted to use this material only as expressly authorized by us.
7.2 You acknowledge and agree that the material and content contained within ATG Tickets is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of ATG Tickets is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
7.3 Except for Personal Data, any information you submit to ATG Tickets , whether by way of comment, any chat room function or otherwise, will not be treated confidentially and you acknowledge that we may use such information for any purposes subject to these Conditions.
8 GENERAL
8.1 If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.
8.2 These Conditions (as amended from time to time) contain the entire agreement and understanding between us in respect of all matters which are referred to herein and supersede any prior written or oral agreement between us relating to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions. However, nothing in these Conditions purport to exclude liability for any fraudulent statement or act.
8.3 The Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

1.1 Protecting your privacy as a user of ATG Tickets is important to us and we strive to keep all information relating to you confidential in accordance with this statement. As part of the normal operation of our services you may voluntarily provide us with information about yourself (‘Personal Data’). The purpose of this Privacy Statement is to explain what Personal Data we collect about you, how that Personal Data might be used and how we protect your Personal Data and privacy.
1.2 We will be happy to answer any enquiries from you regarding this Privacy Statement, the Personal Data we hold about you or the use we make of it. 2. WHAT DATA DO WE COLLECT AND HOW?
Non-members
2.1 if you are merely visiting the public areas of ATG Tickets , we do not collect any Personal Data about you. However, we may automatically collect information about your visits, such as browsing patterns. Information collected in this way does not reveal your contact details or any type of Personal Data. This information is only used in aggregate form to analyse, manage and develop ATG Tickets and is not linked to any individual.
Members
2.2 If you are a member of ATG Tickets we will collect and hold Personal Data about you when you apply to become a member. The Personal Data collected by us will include your full name, password, e-mail address, date of birth, gender, country of residence, postcode and your telephone number/s. From time to time you may also provide other Personal Data which we need to provide you with the service you request, such as your credit card details, other information about yourself, your preferences or your experiences.
3. HOW DO WE USE MEMBERS' PERSONAL DATA?

3.1 We will use all Personal Data for the purpose of providing you with the services you have requested in accordance with the Conditions.
Marketing
3.2 From time to time, we may use your Personal Data to let you know about other services and products that we or our associated companies provide, special offers and also to provide news about our business. This will be in accordance with the preferences for ATG Tickets updates which you have registered with us. You may amend your preferences at any time in accordance with clause 1.2 above.
Legal requirements
3.3 We reserve the right to access and disclose Personal Data to comply with applicable laws and lawful government requests or requests by the police investigating suspected illegal activities, to operate our systems properly or to protect ourselves or other ATG Tickets users. We also reserve the right to disclose Personal Data to third parties if a complaint arises concerning your use of ATG Tickets, and that use is deemed by us to be inconsistent with the Conditions.
Public Forums
3.4 ATG Tickets may make available chat rooms, forums, message boards, reviews and news groups. Please remember that any Personal Data that you disclose in these areas of ATG Tickets becomes public information and you should exercise caution when deciding to disclose any information on them.
4. HOW DO WE PROTECT MEMBERS' PERSONAL DATA?
4.1 When you input any Personal Data into ATG Tickets or request services from us, we use appropriate physical, electronic and managerial security measures to try to prevent that Personal Data from being accessed by unauthorised persons and to ensure that you may input Personal Data safely. This means that sometimes we may ask for proof of identity before we disclose Personal Data to you.
5. COOKIES
5.1 ATG Tickets makes use of cookies which are files placed on your computer that enable us to track certain information relating to your use of ATG Tickets. You may be able to configure your web browser to prevent the use of cookies although some functions or services may not be available. We also allow third party advertisers to advertise on ATG Tickets and such advertisers may also use cookies to record information about your use of the advertisement which you have seen and the types of things you appear interested in.
6.SALE OR MERGER
6.1 If ATG Tickets is sold to or merges with, or if our business is sold to, merges with or enters a joint venture with another company not owned by Ambassador Theatre Group Limited, you should expect that some or all of the Personal Data collected from ATG Tickets may be transferred to the buyer/surviving company. If so, we will seek to obligate the other company to use any Personal Data transferred by ATG Tickets in a manner consistent with this statement, but we cannot guarantee that we will be able to impose that requirement or that the acquiring company will comply.
7. THIRD PARTIES
7.1 From time to time we may enter into a special relationship with another company that is not owned by us to provide additional features on ATG Tickets. As a result of these special relationships, ATG Tickets may sometimes feature co-branded micro sites or webpages.
7.2 You should look for a specific privacy statement on any such co-branded page. Any Personal Data that you provide when signing up on one of these co-branded pages may be shared with our third party partner in accordance with the privacy statement on that page.
8. CONSENT
8.1 By accepting the Conditions or by using the services on ATG Tickets , you consent to the collection and use of your Personal Data by us for the purposes outlined above and for any other purpose which is reasonably necessary for the provision or proper administration of the ATG Tickets service in accordance with the Conditions.
8.2 You agree that your Personal Data may be transferred to countries outside the European Economic Area for the purposes described above to countries which may not provide legal protection of Personal Data equivalent to the level of protection within the United Kingdom.
8.3 if you do not wish your Personal Data to be used in the manner set out in this Privacy Statement or the Conditions please do not use ATG Tickets.
9. CHANGES TO OUR POLICY
9.1 This Privacy Statement is subject to change at any time. We encourage you to review the Privacy Statement regularly for any changes. We will use Personal Data in accordance with the Privacy Statement under which that Personal Data was collected.
9.2 This Privacy Statement is part of the ATG Tickets Terms and Conditions (the ‘Conditions’) and all defined terms shall have the same meaning as those in the Conditions.
Terms and Conditions of Sale
1. DEFINITIONS AND INTERPRETATION
‘Event’ means an entertainment event including, without limitation, a concert, exhibition, sports, theatrical and/or music event to be held at a Venue in respect of which We have the right to sell You Tickets.
‘Tickets’ means tickets or other types of evidence (including electronic tickets) for an Event sold by Us to You on behalf of the organisation responsible for the Event for the right to occupy space at or to attend an Event.
‘Venue’ means any facilities or locations of any nature where the Event is being held.
‘We’ means ATG Tickets (The Ambassador Theatre Group Limited). ‘Us’ and ‘Our’ shall be read accordingly.
‘You’ means you or anybody who in Our reasonable opinion is acting with your authority or permission. ‘Your’ shall be read accordingly.
‘Promoter’ means the person firm or company staging the Event if different from Us and the Venue.
‘Group’ means group organisers, charities, travel and coach companies or other organisations that We have agreed to sell to knowing that the Tickets are intended for resale.
2. INCORPORATION
These Terms and Conditions incorporate and should be read in accordance with the Venue and/or Promoter terms, conditions and regulations, copies of which are available upon request from the Venue. In the event of any inconsistency between the terms in relation to Venue or Promoter requirements, those of the Promoter shall prevail. If no Promoter, those of the Venue shall prevail. These Terms and Conditions are an extension of STAR’s Code of Practice which is available from STAR (0870 603 9011, www.star.org.uk)
3. TICKETS
All Tickets are sold subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase, as purchase of Tickets constitutes acceptance of these Terms and Conditions A valid Ticket must be produced to get into an Event. Removing any part of, altering or defacing the Ticket may invalidate Your Ticket. It is Your responsibility to check Your Tickets as if you have made a mistake it cannot always be rectified after purchase. Please check your Tickets on receipt carefully and contact us immediately if there is a mistake. We will not be responsible for any Ticket that is lost, stolen or destroyed. It is not always possible to issue duplicate tickets. For example for non-seated events where there is a possibility of both the original and duplicate tickets being used, compromising the licensed capacity of the venue. Duplicates may therefore be issued at the discretion of the Promoter or the Venue acting reasonably. If duplicates are being issued, a reasonable administration charge may be levied. We and the Promoter reserve the right to provide alternative seats at an Event to those specified on the Ticket if the staging of the Event reasonably requires, provided they are of no less value to that stated on the Ticket. Where a concession is claimed, proof of identity and concession entitlement (for example of age or student status) may be required. Ownership or possession of a Ticket does not confer any rights (by implication or otherwise) onYou to use, alter, copy or otherwise deal with any of the symbols, trade marks, logos and/or intellectual property appearing on the Ticket.
4. PRICE AND PAYMENT
The price of the Ticket shall be the price set at the time We accept Your order. All prices set are inclusive of any applicable taxes but exclusive of any booking fee and collection or delivery fee. No order will be accepted until We have received full payment. Other requirements regarding the need for clear and transparent pricing information to be supplied at the time of sale, including booking fees, are covered in the STAR Code of Practice.
5. DELIVERY
Tickets will only be delivered to the billing address of the debit/credit card holder unless We specifically offer You the facility for Tickets to be sent to an alternative address. If Your Tickets are not being held at the Venue box office, and You have not received Your Tickets from Us 72 hours prior to the Event, please contact Us. If Tickets dispatched by Royal Mail ordinary post, special delivery or registered post are returned to Us as ‘addressee unknown’ We reserve the right to cancel Your booking and make a refund of the Ticket price only. We reserve the right to make Tickets available for collection at the Venue box office. You will benotified by telephone, email or in writing of the arrangements for collection (using the details provided at the time of ordering) if this becomes necessary. Where there is not enough time to deliver Tickets, You will be told at the point of purchase the arrangements for collection of Your tickets. If You are collecting Your Tickets from the Venue box office, You must have Your acknowledgement of order and the credit/debit card used to make the order with You.
6. CHANGES TO EVENT
The organiser of the Event and/or the Venue reserves the right to make alterations to the published Event programme where reasonably necessary.
7. REFUNDS/EXCHANGES
If you are unable to attend the Event though no fault of Ours, we can offer a ticket exchange facility, subject to availability, if the Event at a Venue managed by Ambassador Theatre Group. In order to obtain an exchange you must contact us 48 hours before the Event. Tickets can be exchanged for a seat of the same value, within its current run at the same Venue. If a discount has been applied to the Tickets, then this will only be honoured within the original terms and conditions of the offer. If the Event has been booked though us for a Promoter or Group then an exchange may not be offered and we would refer to the Promoter / Groups own terms and conditions of sale. Except where We offer an applicable Ticket exchange or resale facility, Tickets cannot be exchanged or refunded after purchase unless the performance is cancelled or rescheduled (subject to below) or where there is a material change to the programme of Event. Where an Event is cancelled or rescheduled (subject to below) by the Venue or Promoter, where an Event is cancelled or rescheduled due to circumstances beyond Our control, or where there is a material change to the programme of the Event, You will be entitled to claim a refund from Us in accordance with this clause. A 'material' change is a change which, in Our reasonable opinion, makes the Event materiallydifferent to the Event that purchasers of the Ticket, taken generally, could reasonably expect. The use of understudies in a theatre performance shall not be a material change. Where an outdoor Event is cancelled or curtailed because of adverse weather, We shall not be liable to make any refund or pay any compensation beyond the refunds that may be payable under the Venue's or Promoter's rules. Where such a refund is sought You must bring this to Our attention as soon as possible upon becoming aware of such change, cancellation or where the Event has been rescheduled, prior to the rescheduled Event. The refund for Tickets equals the face value of the Tickets purchased in accordance with the STAR Code of Practice. Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets except, at Our discretion, where payment was made by cash. These Terms and Conditions do not and shall not affect your statutory rights as a consumer. 8. LIABILITY
Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by You are at your own risk. Liability for the cancellation or rescheduling of an Event, or for material changes to an Event, will be limited to the refund as set forth in Section 7.Neither We nor the Venue nor the Promoter will be responsible for any loss, theft or damage of Your personal belongings, other than caused as a result of Our negligence or that of the Venue or the Promoter or other breach of statutory duty.
9. CANCELLED/RE-SCHEDULED EVENTS
It is Your responsibility to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event. Where an Event is cancelled or re-scheduled, We will use Our reasonable endeavours to notify You using the details You provided Us with at the time of ordering. We do not guarantee that You will be informed of such cancellation before the date of the Event. It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering.

11. Resale/use of Tickets and property
You may not re-sell or transfer a Ticket if prohibited by law. In addition, re-sales or transfers of Tickets may be prohibited for certain events subject to the specific terms and conditions of those events (for example but not exclusively limited to charity events or events where age restrictions may apply because of content of the entertainment or licensing requirements). Where a Ticket is offered for resale in line with these terms and conditions, you must provide to the buyer full details of the ticket. Full details include, if printed on the ticket, the block or tier, row and seat number. Buyers must also be made aware of these terms and conditions and any other terms and conditions that are specific to the event. You should check whether any special terms apply before offering a free Ticket for resale. Free tickets are often provided for specific reasons limiting their transferability.
12. VOID TICKETS
Any Ticket obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void. Any person seeking to use such a void Ticket in order to gain or provide entry to an Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action. Void Tickets are non-refundable.
13 RESTRICTIONS ON THE PURCHASE OF TICKETS
Tickets may be restricted to a maximum number. Any such restriction shall be notified to You at the time You book the Tickets. We reserve the right to cancel Tickets purchased in excess of this number and without the Agent’s agreement, without prior notice unless the purchase of an excess was due to Our error.
14. CONDITIONS OF ADMISSION
The management of the Venue reserves the right to refuse Ticket holders admission to the Venue in reasonable circumstances including for health and safety, licensing reasons or where a Ticket is void. The management of the Venue also reserves the right to request that Ticket holders leave the Venue at any point on reasonable grounds and may take any appropriate action to enforce this right. By way of example, the Venue may remove a Ticket holder who:
1) has behaved in the Venue in a manner which, in the reasonable opinion of the Venue has, or is likely to affect the enjoyment of other visitors; or
2) uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
3) in the reasonable opinion of the Venue is acting under the influence of alcohol or drugs; or
4) fails, when required, to produce proof of identity or age.
You must comply with instructions and directions given by Venue staff and stewards. No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour as suggested in, but not limited to, the examples above.
15. RESTRICTIONS AND PROHIBITIONS
The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside any Venue is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of an Event in breach of these conditions shall belong to the Promoter. The
Promoter and Venue will not be liable for any loss, theft or damage to confiscated items. By attending an Event, Ticket holders consent to filming and sound recording of themselves as members of the audience. The Promoter may use such films and recordings (including any copies) without payment. Ticket holders shall not bring into the Venue or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing material's. Mobile telephones and messaging equipment must be switched off during the Event. Alcohol may only be consumed in public bars and other authorised areas. Smoking is not
permitted unless within a designated smoking Area (if any).
The following are not permitted within any Venue:
I) animals (with the exception of guide dogs);
2) laser pens
3) Your own food and drink (unless permitted by the Venue);
4) bottles, cans or glass containers (unless permitted by the Venue);
5) any item which may be interpreted as a potential weapon including sharp or pointed objects (e.g. knives);and
6) illegal substances.
The management of the Venue reserves the right to conduct security searches from time to time and confiscate any item which, in the reasonable opinion of the management of the Venue, may cause danger or disruption to other members of the audience or the Event or is one of the items not permitted in the Venue as listed above. Every effort shall be made to admit latecomers to Events at a suitable break in the Event, which may be the interval, but late admission cannot be guaranteed.Ticket holders may only leave and re-enter the Venue during an Event at the discretion of the management of the Venue. Otherwise, there will be no re-admission or pass-outs of any kind. The obstruction of gangways, access-ways, exits, entrances or staircases, congregating in nondesignated areas or seeking entry to stands or seats for which You do not hold a Ticket is strictly
forbidden.
16. HEALTH AND SAFETY
Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Event. If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be provided when ordering Tickets. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.
17. DISPUTE RESOLUTION
If any dispute arises out of these Terms and Conditions, We will attempt to settle it. To this end We shall use Our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to both parties. Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days, the parties may attempt to settle it by mediation. To, initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation. The mediation shall be conducted in accordance with the STAR Code of Practice and Dispute Resolution Procedure current at the date of the referral which sets out, the procedures to be adopted, the process of selection of the mediator and the costs involved, and which terms are deemed incorporated into this agreement.

18. WAIVER
If We delay or fail to enforce any of these Terms and Conditions It shall not mean that We have waived our right to do so.
19. ASSIGNMENT
We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.
20. SEVERABILITY
If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
21. THIRD PARTIES
Any person, other than the Venue or Promoter, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts but in this case only We, the Venue, the Promoter and You (or
your assignees permitted hereby) have rights and obligations under this contract.
22. FORCE MAJEURE
For the purposes of these Terms and Conditions, ‘Force Majeure’ means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defense requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure. This Clause does not affect the terms of Clause 7.
23. AMENDMENTS AND VARIATIONS
We intend to rely on the written terms set out here in this document as well as the written terms and conditions of the Venue and the Promoter. You should read the terms and conditions carefully before entering into the contract to ensure that they contain very thing that You consider has been agreed. If they do not then you should speak to any member of staff. After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both You and We agree and it is preferable that this is in writing).
24. NO PARTNERSHIP OR AGENCY
Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions..
25. ENTIRE AGREEMENT
These Terms and Conditions, and the terms and conditions of the Venue and the Promoter and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not) other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
26. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in all respects in accordance with English/Scottish law and the parties agree to submit to the exclusive jurisdiction of the English/ Scottish courts.
ATG Theatre Card Membership Terms and Conditions
These are the terms and conditions which apply to your ATG Theatre Card ('these Conditions'). By purchasing or renewing an ATG Theatre Card (or by using an ATG Theatre Card issued to you as a replacement for your AmbassadorFriends Membership or your LiveCard Membership) you agree to be bound by these Conditions. These Conditions replace AmbassadorFriends Membership Terms and Conditions and LiveCard Membership Terms and Conditions with effect from 1st August 2011.
DEFINITIONS
In these Conditions:
'ATG' and 'Ambassador Theatre Group' (and 'we', 'our', 'ours' and 'us') refers to The Ambassador Theatre Group Limited, registered in England and Wales with company number 2671052 whose registered office is at 2nd Floor, Alexander House, Church Path, Woking GU21 6EJ and each of its subsidiaries and affiliated companies.
'ATG Theatre Card' means the card which is issued to you by the Ambassador Theatre Group following an application in accordance with these Conditions or which is issued to you as a replacement for your AmbassadorFriends Membership or your LiveCard Membership.
'ATG Theatre Card number' means the account number issued to you when you purchased your ATG Theatre Card.
'ATG venues' means all venues owned or operated by the Ambassador Theatre Group. A full list of venues can be found at www.atgtickets.com
'Benefits' means those benefits and discounts at ATG venues and from external providers which are from time to time notified on our website, newsletters or mailings, as available to holders of a valid and current ATG Theatre Card. Additional conditions may apply to individual benefits and discounts.
'Initial Fee' is the fee paid when you purchase your ATG Theatre Card. 'Renewal Fee' means the sum payable by you as set by ATG at the end of the first 12 month validity period and for any subsequent 12 month periods thereafter.
'Our terms and conditions of sale' means those that apply to our customers purchasing tickets and attending any ATG venue as published from time to time.
'Validity Period' refers to a 12 month period from the date of the initial purchase or renewal of your ATG Theatre Card and means the period during which your ATG Theatre Card is valid in accordance with these Conditions.
'Our website' means www.atgtickets.com
1. BENEFITS
1.1 All Benefits are subject to availability and to these Conditions.
1.2 A valid ATG Theatre Card will entitle you to the Benefits but you acknowledge that some or all of the Benefits may be added to, removed or altered by ATG at its discretion.
1.3 Your ATG Theatre Card may be used to purchase the stated number of tickets with the Benefits that are outlined at www.atgtickets/theatrecard or in ATG brochures, subject to availability.
1.4 Additional Benefits offered by external companies are beyond the control of ATG and may be subject to change without notification.
1.5 Any additional fees associated with your ATG Theatre Card and/or relating to the purchase of tickets will be outlined in ATG brochures, print and at www.atgtickets.com/theatrecard
1.6 Any purchase of tickets to events at ATG venues will be subject to our terms and conditions of sale.
1.7 Fee free ticket exchange is offered subject to availability of equivalent value tickets on the dates requested. We reserve the right not to offer an exchange if there is no reasonable prospect of being able to re-sell the tickets which are offered for exchange. No fee will be charged for making an exchange. If tickets of a higher value are requested or if fees or costs (including postage) are applicable to the requested tickets we may require such fees and costs to be paid by you before making an exchange.
2. PURCHASING AN ATG THEATRE CARD
2.1 To purchase an ATG Theatre Card you must be at least 18 years of age and be a resident in the UK.
2.2 An ATG Theatre Card can be purchased online at www.atgtickets.com/theatrecard or by calling 0844 871 7633.
2.3 The Ambassador Theatre Group reserves the right to refuse any application for an ATG Theatre Card.
2.4 When your application for an ATG Theatre Card has been accepted you will be issued with an ATG Theatre Card and an ATG Theatre Card number. Neither an ATG Theatre Card nor an ATG Theatre Card number will be issued until ATG has received full payment.
2.5 Your ATG Theatre Card will be issued to you within 28 working days. 2.6 Your ATG Theatre Card number must be quoted at all times when booking tickets.
2.7 Subject to these Conditions, the ATG Theatre Card will be valid for the Validity Period, commencing on the date that you purchased your ATG Theatre Card.
3. ATG THEATRE CARD RENEWAL
3.1 At least one month before the expiry of the first 12 months of the Validity Period, ATG will offer you the opportunity to renew your ATG Theatre Card for a further twelve-month period. Any renewals will be subject to payment of the then current Renewal Fee.
4. USING YOUR ATG THEATRE CARD
4.1 Your ATG Theatre Card is a personal revocable licence and is, at all times, the property of the Ambassador Theatre Group.
4.2 ATG reserves the right to refuse to supply you with an ATG Theatre Card and can terminate your ATG Theatre Card and/or demand the return of your ATG Theatre Card and/or cancel it at any time if, in its reasonable opinion, you are in breach of these Conditions.
4.3 Your ATG Theatre Card is strictly non-transferable to any third parties. Only the named holder on the ATG Theatre Card will be entitled to use the ATG Theatre Card and to receive Benefits.
4.4 Any Benefits and tickets obtained in breach of these Conditions will be made null and void and ATG may refuse to admit the ticket holders to its venues.
4.5 The Initial Fee and any Renewal Fee are non refundable in the event that an ATG Theatre Card is terminated as permitted by these Conditions.
4.6 The Ambassador Theatre Group may vary the number and location of ATG venues where an ATG Theatre Card can be used.
5. LOST OR STOLEN CARDS
5.1 You must inform ATG if your ATG Theatre Card is lost or stolen.
6. CANCELLING YOUR ATG THEATRE CARD
6.1 You have the right to cancel your ATG Theatre Card within 7 days of the date of receiving your ATG Theatre Card and welcome letter. If you do cancel your ATG Theatre Card within such 7 day period the Initial Fee paid will be refunded to you.
6.2 If you do want to cancel you must call our ticket centre on 0844 871 7633
7. CANCELLATION BY ATG
7.1 ATG may cancel your ATG Theatre Card if you provide any false information at the time of purchase, you misuse your card in anyway or there is any irregularity in the payment of any fees for your ATG Theatre Card or tickets.
7.2 If ATG do cancel your ATG Theatre Card as permitted by these Condition you will not be entitled to any refund of your Initial Fee or any Renewal Fee.
8. DATA PROTECTION
8.1 You must ensure that the information provided by you when you purchase your ATG Theatre Card is accurate and complete and contains your correct name, contact address, telephone number and/or email address and any other requested details.
8.2 It is your responsibility to inform ATG of any personal detail changes.
8.3 The Ambassador Theatre Group will use this personal information to provide you with all information connected with the supply of your ATG Theatre Card including; ticket offers, benefits, renewals, brochures and newsletters, events, offers, changes to the ATG Theatre Card scheme.
8.4 By purchasing an ATG Theatre Card you consent to your information being used in this way.
9. GENERAL
9.1 If any part of these Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.
9.2 These Conditions (as amended from time to time) contain the entire agreement and understanding between you and us in respect of all matters which are referred to herein and supersede any prior written or oral agreement between us relating to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions. However, nothing in these Conditions purport to exclude liability for any fraudulent statement or act.
9.3 These Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
